This page is designed to provide links to recent unpublished opinions from the Oklahoma Court of Criminal Appeals. To the top are links to recent unpublished opinions indexed both by subject and alphabetically by appellant’s last name. These opinions were chosen for their potential value to defense lawyers – reversible errors, promulgation of new procedure, emerging issues, etc. They are only selected cases of interest, primarily on direct appeal, and do not reflect all of the Court’s unpublished activity.
The Rules of the Court of Criminal Appeals now permit citation to unpublished opinions in certain circumstances. Rule 3.5(c)(3) states:
In all instances, an unpublished opinion is not binding on this Court. However, parties may cite and bring to the Court's attention the unpublished opinions of this Court provided counsel states that no published case would serve as well the purpose for which counsel cites it, and provided further that counsel shall provide opposing counsel and the Court with a copy of the unpublished opinion.
Unpublished opinions may also be helpful as persuasive authority in trial courts throughout the State.
The format of these opinions allows the user to print them as graphics files, so that each opinion will appear exactly as the "original" that was issued by the Court.
Check back each month for updated case lists. As a start, we are including cases decided after July 1999, but we hope to review and include earlier unpublished cases as time allows.
